THE Lusaka Magistrate’s Court has established a prima facie case in a matter in which former MMD president Nevers Mumba is charged with two counts of criminal trespass and giving false information to a public officer when he allegedly stormed ZNBC newsroom.
Dr. Mumba was found with a case to answer by Magistrate David Simusamba after it was found that the prosecution proved its case beyond reasonable doubt.
In his ruling, Mr Simusamba ruled that it was not in dispute that the accused stormed ZNBC with intent to annoy.
He further ruled that it was also not in dispute that Dr Mumba gave false information to police officers who were on duty at the main gate of Mass Media complex in order to gain access to the premises.
The State called eight witnesses to give evidence.
And Dr. Mumba’s lawyer M. Museba told the court that his client would give evidence on oath and five witnesses would be called.
The allegation was that Dr. Mumba on September 8, 2016 in Lusaka jointly and whilst acting together with another person unknown unlawfully entered into Zambia National Broadcasting Corporation (ZNBC) newsroom with intent to intimidate and annoy the staff and complain about a news item.
The second charge arose at that same gate where Dr. Mumba allegedly told police constable Rapson Mwanza that he had an appointment with ZNBC’s news editor when, in fact, not
Dr. Mumba is expected to open his defence on February 14.
