Court orders arrest of no-show Libyan accused

THE Lusaka Magistrate Court has issued a warrant of arrest against LAICO – Zambia Ltd General Manager, Nabill Sobhi Ibrahem Elmurabet, a Libyan for absconding court proceedings.
This was after State Prosecutor, Michael Nyundwe made an application before court to have the accused person brought on bench warrant after missing court proceedings on two occasions.
Elmurabet missed court on November 12 and 14, 2024 without any reasons.
“The accused person is not present before court, and this is the second time is absconding court without any reasons, may he be brought on bench warrant,” Mr. Nyundwe submitted.
And Principal Resident Magistrate, Idah Phiri has warned that the accused should be brought on warrant without fail returnable on December 13, 2024.
Elmurabet, 45, of unknown house number in Lusaka is charged with four counts of forgery contrary to Section 347 of the Penal Code Chapter 87 and uttering false documents contrary to Section 352 of the Penal Code Chapter 87 of the laws of Zambia.
He pleaded not guilty to all the charges.
It is alleged in count one that Elmurabet on October 3, 2022 in Lusaka with intent to deceive or defraud, did make a false document namely Patents and Company Registration Agency form 10 part C dated October 3, to show that it was genuinely issued and signed by Shukri Esidieg Esidieg a director at LAICO Zambia Limited and Marilyn Sipia Mwamba when infact not.
It is also alleged that Elmurabet on October 3, 2022 in Lusaka, knowingly and fraudulently, uttered a false document namely Patents and Company Registration Agency form 10 part C dated October 3, 2022 in the names of Eljaiedi and Mwamba to the registry at PACRA.
The court has since set December 13, 2024 for return of bench warrant.
