Former Zambia Army Soldiers challenge discharge in Court

By GRACE CHAILE

TWO former Zambia Army soldiers, have taken the Attorney General and the Army Commander to the Lusaka High Court. They are contesting their discharge from employment, which they claim was unfair and unlawful.
According to Chuma Nkuwa and Hellem Mwalimu, they were discharged after being accused of sneaking marijuana into the army camp.
However, they claim that the investigation by the Drug Enforcement Commission (DEC) found them not liable, and they were subsequently released.
Despite their exoneration, the Zambia Army discharged them from service, citing possession of marijuana as the reason.
Nkuwa and Mwalimu argued that this decision was irrational, illegal, and improper, as they were never charged or given a chance to defend themselves.
The two former soldiers are seeking an order of certiorari to quash the decision of the Army Commander, as well as damages and costs.
They are also asking the court to allow them to continue enjoying their privileges and entitlements as regular soldiers.
