Chilangwa’s case on Mutti’s declaraing Kawambwa seat vacant goes to ConCourt

THE Chinsali High Court has referred a case involving jailed former Kawambwa Member of Parliament Nickson Chilangwa to the Constitutional Court.
Chilangwa is challenging the decision of Speaker Nelly Mutti to declare his seat vacant while his appeal against conviction and sentence is pending. Judge Willie Sinyangwe made the referral to seek interpretation of articles 72 (2) (f) and 70 (2)(b) of the constitution. The Attorney General argued that the Speaker’s decision was not discretionary but occurred by operation of law following Chilangwa’s conviction and sentencing to five years imprisonment with hard labour.
