ConCourt says it has power to nullify its own decisions of finality

THE Constitutional Court of Zambia has recanted all of its past four judgements declaring former President Edgar Lungu eligible to contest future elections, including the 2026 presidential election.
The court, comprising seven Judges, unanimously concluded that former President Lungu had already served two terms in accordance with the Constitution and declared him ineligible to contest the 2026 general election.
Central to the decision was the interpretation of former President Lungu’s first term, which ran from January 25, 2015, to September 13, 2016.
The court determined that this period, following the death of President Michael Sata, constituted a full term under Article 106(3) of the Zambian Constitution.
